Is FPS Class Counsel or a Claims Administrator?
No. FPS is a 3rd party class action settlement claim management and recovery consulting firm.
What are some of the services that FPS provides?
FPS submits our Clients’ claims to participate in qualified refunds provided by class action antitrust settlements that have potential value for our clients.
How does FPS manage its clients’ claims for settlement?
When you retain FPS as a Client, FPS will work within your guidelines to manage the claims process. FPS will notify you when we believe that you may be eligible to participate in valuable settlements; we will take action to assure that all of your eligible business units (e.g., subsidiaries, divisions, acquisitions and divestitures) are included in the claim process; to reduce the support needed from your in-house staff, we will provide advice on what, if any, documents need to be collected and maintained, and, when requested, we will assist in that effort; when required documents are not available or are too burdensome to collect, we will negotiate on your behalf to develop innovative alternatives to satisfy documentation requirements; we will prepare, assemble and submit your claim package, and manage it throughout the claims processing phase, including working with you to address any concerns or questions the claims administrator may have; we will provide regular updates on the recovery process; we will review your payment to assure that it has not been under calculated; and we will follow up with you to assure that your recovery check is deposited. FPS’s class action claims specialists are always available to answer any questions you may have.
Does FPS provide legal services or advice?
No. FPS is not your attorney; is not class counsel or the claims administrator; does not practice law; does not provide you with legal representation or advice; and does not possess any specialized legal skills necessary to complete any forms necessary to obtain your recovery. FPS does employ attorneys who have substantial legal training and experience in, among other matters, prosecuting, settling and administering class action claims. And like all of FPS’s employees, those attorneys advocate on your behalf in connection with your claim. How Do I Hire FPS?
If you wish to retain FPS to manage your class action claim, you must sign our Service Authorization (available upon request). FPS’s Service Authorization clearly informs our clients that we are a third-party class action settlement claims recovery firm, not class counsel or a claims administrator, and that even though any claimant may prepare and submit a claim on their own without FPS’s assistance and without incurring any fees or costs to FPS, our clients, by executing FPS’s Service Authorization and returning it to us, are retaining FPS to manage their claims on their behalf and will pay to FPS the commission specified in their Service Authorization only as a percentage of the recoveries that they receive. Once FPS receives your executed Service Authorization Agreement, we will begin to assist you with your claim.
Do I need to hire FPS to receive a recovery from a class action settlement?
No, you do not have to hire FPS or any other third-party claim filing firm in order to obtain a recovery. You can prepare and file your own settlement claim if you choose to do so. However, businesses such as yours have retained FPS for their claim management and have found exceptional value in FPS services.
What is FPS’s Compensation?
FPS’s fees are a contingent commission as specified in our Service Authorization which FPS is paid only if you receive a recovery. FPS will receive your payment from the claims administrator, deduct our service fee, and then send to you the balance of the recovery with a photocopy of the original recovery check (or other documentation) that FPS receives from the claims administrator.
FPS’s case summary provides potential clients with information about specific class action and other settlements. More detailed information is included in the settlement notice that class counsel prepares, the court approves and class counsel and the claims administrator disseminates and the summary settlement notice that the court approves and that class counsel has published. FPS also provides its clients with regular updates on the settlement and claims process. Those updates are provided via email, FPS Refund Alerts newsletter, and posted on FPS’s website. Additional information also may be obtained from class counsel and from the claims administrator per case, through court-approved settlement websites.
